On Sunday, June 29, 2014 at 3:44pm the Sheriff’s Office responded to a residence on Mayflower Drive in reference to a child custody exchange. The reporting party was concerned her ex-husband, Mr. Donald Wallace, might have been drinking and would cause a problem when he brought their two children home to exchange custody.

While Sheriff’s deputies were still on-scene, Mr. Wallace drove by the residence with his two children in the back seat of his 1997 Toyota Corolla. Mr. Wallace accelerated and tried to avoid the deputies by turning down a side street. A witness in the neighborhood observed Mr. Wallace run over a curb, which caused two of the vehicle’s wheels to lift off the ground. The witness indicated that he could hear Mr. Wallace’s children screaming and crying as the vehicle drove by. Sheriff’s Deputies caught up to Mr. Wallace and stopped him in the 3400 block of Elmridge Drive.

Mr. Wallace was uncooperative during standardized field sobriety testing and resisted initial attempts to take him into custody. Mr. Wallace had to be forcibly restrained and was then secured in the rear of a Sheriff’s Office vehicle. Mr. Wallace later submitted to a breath test at the confinement center. The test result indicated Mr. Wallace had breath alcohol concentration of .26%, which is more than three (3) times the legal limit of .08%.

Mr. Wallace was booked into the jail on the following charges: Child Neglect as a Class D Felony (2 counts), OMVWI with a Passenger under 18 yoa as a Class D Felony, OMVWI as a Class A Misdemeanor, OMVWI with a BAC of .15% or more as a Class A Misdemeanor, and Resisting Law Enforcement as a Class A Misdemeanor.
